Power of Attorney Litigation | Mannion Prior, LLP

Power of Attorney Litigation

A Power of Attorney is a document by which one persons, a “Principal,” authorizes another person, an “Agent,” to act on behalf of the Principal.  Powers of Attorney are powerful estate planning tools, but they also can be subject to abuse.

Mannion Prior has litigated leading cases involving the mental capacity required for a Principal to execute a Power of Attorney, the authority of agents under Powers of Attorney, and revocation of an Agent’s authority.  Mannion Prior also has successfully defended guardianship or incapacity proceedings based on the existence of a valid Power of Attorney as a “less restrictive alternative” to a guardianship.  In addition, Mannion Prior attorneys have presented material on Powers of Attorney to judges and attorneys throughout Pennsylvania.
